1. ACCEPTANCE OF THE TERMS

These Terms of Use ("Terms") constitute a legally binding agreement between Hoomuse Online Marketplace ("Hoomuse," "we," "us," or "our") and you ("User," "you," or "your"). By accessing or using the Hoomuse.com website, mobile applications, and related services (collectively, the "Platform"), you agree to comply with these Terms.

If you do not agree with any part of these Terms, you must not use the Platform. We reserve the right to modify these Terms at any time without prior notice. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

2. IMPORTANT DISCLAIMERS

The Platform operates on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Hoomuse does not:

• Guarantee the accuracy, safety, or legality of listings.
• Verify the identity of users or the authenticity of goods/services.
• Assume responsibility for transactions between buyers and sellers. Users are solely responsible for:
• Verifying goods before purchase.
• Ensuring compliance with applicable laws.
• Conducting transactions safely (e.g., meeting in public places).

3. ACCOUNT REGISTRATION

To access certain features, you must register an account ("Account"). You agree to:

• Provide accurate and complete information.
• Maintain account security and notify us of unauthorized access.
• Be at least 18 years old or use the Platform under parental supervision. We may suspend or terminate Accounts for:
• Violations of these Terms.
• Suspicious or fraudulent activity.

4. SERVICE DESCRIPTION

Hoomuse is an online marketplace where users can:

• Post listings for goods/services.
• Communicate with other users. Hoomuse is not:
• A seller, buyer, or agent in transactions.
• Responsible for user disputes or tax obligations. We reserve the right to:
• Remove listings violating these Terms or laws.
• Modify or discontinue services without notice.

5. USER RESPONSIBILITIES

You represent and warrant that:

• You comply with all applicable laws.
• Listings are truthful, lawful, and do not infringe third-party rights.
• You will not post prohibited items (e.g., counterfeit goods, illegal services).
• Prohibited activities include:
• Posting false/misleading information.
• Harassment, fraud, or spam.
• Unauthorized data collection or malware distribution.

6. FEES & PAYMENTS

• The Platform is free to use, but certain premium features may require payment.
• Fees and payment methods are listed on the Platform and subject to change.
• Payments are non-refundable unless required by law.

7. INDEMNIFICATION

You agree to indemnify Hoomuse against any claims arising from:

• Your use of the Platform.
• Your breach of these Terms.
• Your interactions with other users.

8. LIMITATION OF LIABILITY

Hoomuse shall not be liable for:

• Indirect, incidental, or consequential damages.
• User disputes or third-party actions. Our maximum liability is limited to GHS 560 or fees paid in the last 6 months, whichever is lower.

9. INTELLECTUAL PROPERTY

• You retain ownership of content you post ("User Content"), but grant Hoomuse a non-exclusive, worldwide license to use, display, and distribute it.
• Do not post infringing content. Report violations to support@hoomuse.com.

10. GOVERNING LAW & DISPUTES

• These Terms are governed by Ghanaian law.
• Disputes shall be resolved through arbitration at the Ghana Arbitration Centre in English.

11. MISCELLANEOUS

• If any provision is invalid, the rest remain enforceable.
• We may transfer rights under these Terms without consent.
• Failure to enforce a provision does not waive our rights.
